If you look at most release forms for ligitimate rescues there is the following phrase.
"Surrenderer states that they are legally in possession of the bird and have the right to place it, and that no other person has any legal or financial claim on the bird."
The problem is she gave the bird to this person and probably had an oral contract or condition stating he would return the bird if such a situation arised. Although oral contracts and agreements can be binding they are usually hard to enforce. Once you give something away it is no longer yours and the person you give it to may do as he wishes as long as there are no terms or conditions set in writting you really don't have a leg to stand on.
She may try talking to the person she gave the bird to to see if he can get it back from the rescue or if that fails she can contact the rescue herself. If all else fails have her fill out an adoption application with the rescue and re adopt the bird.
